Terms and Conditions for the use of the My GWW portal.
My GWW Terms and Conditions
The following sets out the terms and conditions that apply to Users of the My GWW platform.
1. Agreement
1.1 By registering to use My GWW you agree to be bound by these Terms.
1.2 The following words are defined as follows:
Content means everything displayed on My GWW, including without limitation all information, bills, figures, text, materials, graphics, software, tools, results derived from the use of software and tools, advertisements, names, logos and trade marks on My GWW and includes third party material.
Greater Western Water, GWW, we and us means Greater Western Water Corporation ABN 70 066 902 467.
Loss means loss, damage, cost or expense (to any person or property) including consequential or indirect loss or any loss of profits, data or revenue.
My GWW means the Greater Western Water online portal.
Terms means these terms and conditions.
Third party material means third party material provided through My GWW, and material and/or documents relating to or provided by third parties.
Users means all customers of GWW including residential, business and multi-account customers.
2. Two-factor authentication, account number and password
2.1 My GWW requires two-factor authentication (2FA) for logging in. This adds an extra layer of security by asking for both a password and a second form of authentication via a unique code sent to your registered mobile and email address.
2.2 You must keep your account number and password confidential at all times. You must ensure the security of your login credentials and any devices used for 2FA. You must not share your 2FA codes or password with others. You must not let anyone who does not share your account to use your account number and password.
You are responsible for all activities that occur through the use of your password.
2.3 Unauthorised use and allocation of passwords may lead to revocation of access to My GWW for you or your organisation.
2.4 You must immediately notify us if your password details have been compromised, are known by a third party or there has been unauthorised use of your account.
3. Acting on behalf of an organisation
3.1 To use My GWW to access content or to undertake any action for an organisation, you warrant that you:
(a) are currently authorised by that organisation to access that content or undertake that action on its behalf, and that authorisation must not have been revoked; and (b) if that authorisation is based on you holding a certain position within that organisation, you currently hold that position.
3.2 You agree that we may rely on that warranty unless we receive prior written notice from you of any change or update to the information provided by you. Any such varied information will be covered by this warranty.
4. Access to My GWW
4.1 You acknowledge and agree that:
(a) GWW does not guarantee the accessibility or uninterrupted operation of My GWW; (b) GWW will not be liable for any loss resulting from any interruption or unavailability of My GWW, in whole or part, whether because of the failure of the communication network, ancillary equipment, unavailability of third party content or any other circumstance beyond our reasonable control; (c) it is your responsibility to use other means of obtaining content if, for any reason, My GWW is unavailable or interrupted; and (d) We may make changes to My GWW at any time and these changes may affect your rights or obligations as a user of My GWW. Any changes may be made without notice by publishing variations in My GWW.
5. My GWW security
5.1 GWW does not accept liability for the security, authenticity, integrity or confidentiality of any actions or communications made through My GWW.
5.2 GWW makes no warranties that My GWW is free of infection by computer viruses or other unauthorised software. We will not be liable for any loss resulting from any breach of a security measure (including viruses or other unauthorised software).
6. Intellectual Property
6.1 The intellectual property rights (including copyright) in My GWW and all owned by or licensed to GWW.
6.2 You may not reproduce, adapt, modify, communicate to the public, or otherwise use any part of the content or My GWW without the prior written consent of GWW.
7. Privacy
7.1 We respect your right to privacy. We collect, use and disclose personal information as set out in our Privacy Policy.
8. My GWW
8.1 GWW may:
a) limit your ability to use the My GWW; b) terminate your access to the My GWW at any time.
8.2 GWW may cancel, amend or replace the Terms from time to time. If we do, we will give you notice of the change and the date from which the change applies, and the Terms will be deemed to be amended to reflect that change. We will notify you of the change via your nominated email address or mailing address.
9. Indemnity
9.1 You will be responsible for (and you indemnify GWW against) any Loss or damage to any person arising from any one of the following:
a) any breach by you of these Terms; b) any wilful, negligent or unlawful act or omission by you in relation to, or in the course of using, My GWW.
10. Limitation of liability
10.1 GWW will not be liable for any loss of any kind resulting from:
a) the use of or inability to use My GWW; b) the use of or reliance on any content provided through My GWW. You must rely on your own assessment or seek independent advice in relation to any Content; c) unauthorised access to or alterations of your actions or communications to or from My GWW; d) activities resulting from the loss or misuse of your account number; password or other access mechanism; e) statements or conduct of any third party; or f) any other matter relating to My GWW.
11. Disclaimer of warranties
11.1 Except as specified in these Terms, GWW gives no implied or express warranties in relation to the use of My GWW. All warranties are, to the fullest extent permitted by law, expressly excluded.
11.2 GWW makes no warranty that
a) My GWW will meet your requirements; b) My GWW will be uninterrupted, timely, secure, or error-free; and c) the content that may be obtained from the use of My GWW will be accurate or reliable.
12. Multi-account user terms
12.1 To use the My GWW multi account you acknowledge that you operate as an eligible managing agent and must:
a) manage five or more properties within our service area; b) provide evidence of financial authority for properties managed; c) agree to notify GWW immediately when there is a change to financial authority circumstances; and d) complete a managing agent registration process.
12.2 By agreeing to these terms, managing agents are bound by the My GWW multi-account payment terms as follows:
a) New accounts must be paid in full (zero balance) prior to registering on My GWW multi-account portal. b) Accounts must be paid in full by the due date listed on the bill. c) Payments must be completed via credit card or electronic funds transfer (EFT) on the multi-account portal. For EFT transfers a remittance number must be submitted via the multi account portal to complete the EFT payment. d) Understand and acknowledge that failure to comply with the above payment terms may result in termination of your My GWW multi-account and managing agent registration.
12.3 To register a multi-account, GWW requires a managing agent to maintain accurate account information including:
a) First and last name for each registered user; b) Mobile phone number for each registered user; c) Unique email address for each registered user; d) Organisation name or operating entity; and e) Australian Business Number (ABN) or Australian Company Number (ACN).
